Due to poor conditions in the Russian prison, constantly writing complaints 51-year-old Zamolski’s dream of returning to Lithuania has become more real than ever.
Ekaterinburg’s Chkalov district court does not see why Zamolski, who has been sentenced to 15 years in prison for armed robbery and attempted murder, should be in a Russian prison.
Penalties cannot be changed
“R. Zamolski does not have a Russian citizen, does not have permanent residences when the sentences have already been served, paid the lawsuit, committed crimes under Lithuanian law, and are considered crimes for which he is sentenced to death and sentenced,” the Chkalov district court decides.
He has no doubt that the freedom imposed on R. Zamolskis and the sentence of admission in Lithuania will not be changed to leniency and he will not be released ahead of time.
This obliges Lithuania to the agreements signed in 2002 between the two countries. In addition, the Lithuanian Ministry of Justice has received a statement that R. Zamolskis will not be released until August 14, 2029.
The prosecutor’s office does not want to spend
R. Zamolski himself did not take part in the trial, proving that he does not speak Russian and has no legal education.
His interests were defended at the hearing by lawyer and wife Svetlana Zamolskienė, who, after a decision in favor of her husband, is pleased that a Russian court has examined the case for the first time on the basis of the law.
This court decision is not final, he can still get an appeal to a higher court within ten days.
This can be done by the prosecutor’s office, which opposes sending R. Zamolskis to Lithuania. He is said to be dangerous to society and can therefore be transferred to his homeland only after serving his full sentence.
The requests were answered in silence
Our law enforcement officers have been trying to return R. Zamolskis to Lithuania since August 2014, when a Lithuanian was detained in the city of Yekaterinburg and found himself behind bars for crimes committed in Russia.
Russia has long ignored Lithuania’s request for legal aid – it began to respond to them only a couple of years ago.
In September 2019, R. Zamolskis’ request to Lithuania was subjected to a psychiatric-psychological examination, and it seems that the man is healthy and can be held responsible for his crime.
After receiving the experts’ findings, Russian law enforcement officers also tried to interrogate Zamolski, but this statement that he is innocent and wants to give evidence.
Serious accusations await
Although he did not receive explanations from R. Zamolskis, in February of this year the Lithuanian Prosecutor’s Office managed to complete the pre-trial investigation initiated against him 20 years ago and referred the case to the court.
R. Zamolskis is accused in Lithuania of a crime committed in 2001 – two murders, an attempt to kill 14 people, illegal firearms, ammunition, explosives and numerous robberies. The victims in this case are a civil action against R. Zamolski, in which the total amount is more than half a million euros.
The case was transferred to the Panevėžys Regional Court.
The family is getting ready for the trip
If R.Zamolskis is returned to Lithuania to serve his sentences, his wife with two young children also intends to come here.
In 2018, S.Zamolskienė and her daughter Intiridika and son Ridikas were already trying to settle in Lithuania, and the Migration Department ordered her to leave, because the woman applying for a Schengen visa was deceived by an employee of the Lithuanian Embassy.
After declaring that she needed a visa as a tourist, at the beginning of August a woman with her children came to Kaunas, registered them for school, bought an apartment and decided to stay in Lithuania permanently.
The fraud did not slip through the eyes of the officials of the Migration Department, therefore the visa issued to S. Zamolskienė in November was revoked, and she herself was told to declare Lithuania as much as possible.
