The Lyon administrative court annulled a prefectural decree authorizing the establishment of a large logistics warehouse near Lyon, which resulted in the destruction of several species, pinning the prefect of the Rhône for having “disregarded” the Environmental Code.
This site of nearly 20,000 m2 was to be built in the town of Sary (Rhône) by the land company Argan on behalf of the pharmaceutical company Fresenius Medical Care, located in Savigny, about ten kilometers away.
32 protected species
A prefectural decree of January 2020 had issued a “single environmental authorization” for the construction of this warehouse.
But the works “will result in the destruction, alteration or degradation of breeding sites or resting places of 32 protected species, as well as the destruction and disturbance of seven protected species of reptiles and amphibians, including the Newt. crested “, notes the court in its order of October 7.
Seized by the association France Nature Environnement and a local collective, the court also notes that “if it provides for the creation of about twenty jobs (…) nothing allows to say” that this warehouse “would promote the creation 250 additional jobs at the Savigny production site “.
The court considers that the prefect of the Rhône “disregarded” certain provisions of the Environmental Code by “holding that there was no other satisfactory solution”, while sites “would be available” in Belleville-sur- Saône, 52 km from Savigny.
