Leberkässemmel case in Munich: plaintiff withdraws
The plaintiff wanted to claim 100 euros in damages for his defective car windshield wiper at the Munich Higher Regional Court (OLG). They damaged the policewoman when she stuck a parking ticket underneath.
Knöllchen after buying a butcher’s shop
At the time in question, the man was fetching a meat loaf from a butcher’s shop in Munich-Bogenhausen. He had parked his limousine in a no-parking zone. Because there was a lot going on in the butcher’s shop, the man only came back after a while. He then found not only a pebble, but also the defective windshield wiper, as he reported.
Establishing the truth in the court of justice
At the Munich Regional Court, however, his claim for damages had failed. That is why the appeal hearing was now held in the next instance. In order to establish the truth, the OLG judges then partially relocated the hearing to the open air. There, the controversial event, including parking tickets and car windshield wipers, but without the meat loaf, was, so to speak, re-enacted.
Allegations not confirmed
The taking of evidence did not confirm the plaintiff’s allegations, a court spokesman then informed Bayerischer Rundfunk. So the policewoman can’t help the broken windshield wiper. On the advice of the responsible senate, the plaintiff then withdrew.
