Toulouse. A garage is built 3 cm from their windows: they obtain the suspension of the work

The dispute that opposes Cyrielle and Matthias to their neighbor is simply surrealist.
As we mentioned last July, after long months of research, this young couple bought the house of their dreams: a beautiful Toulouse built in 1860, located in the Lafourguette district, near Saint-Simon (Haute-Garonne).
An ubiquitous situation
But the fairy tale quickly turned into a nightmare after the construction of a garage-workshop less than 3 cm from their wall garden side, all separated by a thin layer of polystyrene.
Unable to retract, Cyrielle and Matthias embark at the same time on the complete renovation of their house and on the legal steps to stop the work of the neighbor. In vain.
Public institutions, lawyers, municipal police, administrative tribunal, open letter to the mayor of Toulouse, Jean-Luc Moudenc… nothing to do, “after more than two years of litigation, we are still at the same point. That is to say nowhere ”, lamented the two Toulouse residents at the beginning of the summer.
Entangled in an ubiquitous situation and without real solutions, they had decided to share their misadventure on social networks with the creation of a Facebook page, followed today by nearly 1,000 people.
A “phalanx” separates the two walls
So three months later, where are they? Well, their persistence paid off in the end. Cyrielle Matthias have indeed and a new first victory with the temporary suspension of work until order.
The situation was unblocked thanks to the hard work of our new lawyer Me Audrey Marty who sued not only our neighbor but also our notary and the real estate agent who sold us the house. That was in mid-July. In the meantime, relations with our neighbor have strained. A few days before the hearing, he once again modified the site plans. He destroyed the walls but kept the screed on the ground … to finally rebuild the walls. Kinds of courtyards associated with 1.9 meters from our windows. On the other hand, the rest of the construction is still located a phalanx from our facade. ”
A bailiff also came on site to draw up an inventory. “He even went to our neighbor’s house, who finds himself in the same situation as us, namely: with a humidity level in his exterior wall above 90%, the appearance of cracks… attributable to the noise of the work and to the outings. -returns of the workers ”, indicates the young woman.
A commissioned legal expert
The legal battle began on Monday, August 30. Cyrielle and Matthias were heard by the president before the floor was given, not to their neighbor, absent in court, but to his lawyer. The decision came out a week later:
A forensic expert has been commissioned. And while awaiting his expertise, the magistrate ordered the suspension of work with the ban on touching the construction. The expert’s report is expected at the start of 2022. “
Still a long way
If the couple from Toulouse is delighted with these few months of respite, they know: there is still a long way to go. “It’s going to be difficult but we believe in it. We have been fighting for more than two years and we will continue. Our goal is to promote the complete demolition of this garage-workshop and especially that it can no longer rebuild ”, conclusion Cyrielle who hopes to finally benefit from the purchase of their house, more than two years after their move.
