Prague – The District Court for Prague 8 will hear today the lawsuit of Senator Lukáš Wagenknecht (Pirates), who challenged the creation of trust funds of Prime Minister Andrej Babiš (YES). According to earlier information, Wagenknecht claims that, according to the Civil Code, a trust is a tool for the management of third-party assets, not its own assets. According to which Babiš is closely connected with its own property through trust funds. Babiš added the Agrofert holding to the trust fund in 2017 due to the Czech Conflict of Interest Act and claims that it has no influence over it.
According to Wagenknecht, Babiš, by setting up trust funds for himself, circumvents not only the purpose of the Civil Code, but also the purpose of the Conflict of Interest Act, so that he can continue to draw on public funds. According to the senator for naming illegality, trust funds would have to be abolished so-called from the beginning, when they would be seen as never having been created.
The European Commission (EC) investigated a possible conflict of interest of the Czech Prime Minister Babiš, and a final report was published in April this year, according to which Babiš is in a conflict of interest because he controls Agrofert even after investing in trust funds and participates in decisions on EU distribution. Grandma denies.
In addition to the EC, Babiš’s possible conflict of interest was also dealt with by the Municipal Office in Černošice, which is an office with extended powers for Průhonice, where the Prime Minister lives. In September, he fined Babiš 250,000 crowns. In the Office’s view, the Prime Minister committed an offense against the law on conflict of interest by controlling the media. According to Babiš, the decision is illegal and violates his fundamental rights, because the office twice investigated it for the same act. He filed a lawsuit against the office, which should be heard by the Regional Court in Prague on Friday. The Prime Minister also announced that he would appeal against the decision of Černošice.
