The question aboutabortion subjected to referendum in San Marino asked citizens three things: whether to agree that the woman could consider pregnancy within the 12th week of gestation, and also subsequently in the case of danger to her life or if there were anomalies and malformations of the fetus that involved a serious risk to one’s physical or psychological health. 77.28% of the voters he said to Yes; The 22.72% from No. Now it is up to Parliament to write a law, which, given the majority of Yes, takes into account the demands of citizens. Nevertheless, the transition from the referendum question to the law will not be easy at all for a series of gray areas that the same question brings to the attention of the legislator.
San Marino abortion referendum, here are the critical points
The first perplexities arise from the indeterminacy of the maximum time limit within which an abortion can be made. By way of example, it may be useful to understand the terms of the problem to remember that according to Italian law this maximum limit has been set between 21 and 22 weeks of pregnancy, because beyond this term the fetus can live independently. In other words, Italian law has established a watershed between the condition of the fetus unable to survive from the maternal womb and the child who could be born and, helped by the neonatal intensive care (TIN), could survive peacefully. Today, it is worth remembering that babies who weigh less than 5 ounces at birth survive! The advances in science and technology in this field have been strongly urged by parents who have a child at any cost and not infrequently children conceived with medically assisted procreation (MAP) are born premature and underweight. But it is precisely that in collaboration with the neonatologists of the NICs to deliver these babies in specialized incubators, until they can be brought home.
Now, if you do not want to accept the principle that every child has the right to live from the moment of conception, the difference between a fetus, still incapable of autonomous life, and a child who can already live independently, is quite evident. Having placed no limit on the time of abortion greatly changed the perspective and responsibility of those who intervene in the abortion. If the future law of San Marinosse completely indefinite this term, it could also be sad that all women, mostly Italian, who come to make this decision out of time, went to abort in San Marino.
The second perplexity concerns the reference to the anomalies and malformations of the fetus, so it becomes clear that we are facing a selective abortion with undoubted eugenic roots, with all that this term evokes. We know well that in many countries children with Down syndrome are no longer born because they are aborted earlier. Their misfortune is that diagnosing Trisomy 21 is very easy, far too easy; but in doing so we ignore how these children can have a peaceful life; they can achieve important personal goals and above all they are capable of deep and lasting emotional relationships. But what cannot be forgotten is that science has made important progress in many areas; it made possible not only an early diagnosis, but also an equally early therapy, capable of radically changing the natural history of the disease and making people’s lives much better. I am thinking, for example, of the SMA, which thanks to the research supported incessantly by parents who had children in these conditions, in a few months has found both a genetic test that allows their diagnosis even before birth and above all a therapy that almost normalizes. total their life. Without the love of their parents, without their resilience, and without the advances in science this would not have happened. Perhaps they could have been aborted, with no other prospect for themselves and others.
The third concern concerns the serious risk to a woman’s physical or psychological health. We all know to what extent women’s mental health is conditioned by the objective difficulties that surround it: by poverty, even if not extreme, by the complicated working situation, with the risk of losing their job or having to give up all sacrifices. made to reach a happy position, to conflict, often to the limits of conflict. All stressful conditions that in some moments make it impossible to think of being able to make room even for a child who may arrive suddenly, not expected, and perhaps not desired at that moment. All in a time of precarious affective relationships, which often see very fragile unions and with little guarantees of continuity. There is no doubt that in these moments maternity support is also measured in terms of significant economic aid; of professional guarantees; of accessible and free services. Women’s health is a social indicator that is extremely sensitive to the quality of well-being that exists in every country. abortion it does not solve the problem, it limits itself to setting it aside, moreover to leave a vulnus in the hearts of women that is not easy to forget, as is amply demonstrated by many testimonies.
Referendum-mania, checkmate on non-negotiable values
Striking as in this period of Referendum-mania above all the famous non-negotiable values are in check; it has come to the point of sacrificing them all, without exception, on the altar of the principle of self-determination. In a matter of weeks, all the great ethical issues have been overturned. The logic of do-it-yourself has won in terms of negotiations. No one can impose on anyone what to do or not to do, because there is no other criterion of choice than one’s own judgment, which is completely self-referential. Only I can establish what is right and what is not; I do it starting exclusively from my personal convenience. Everything begins and ends with me. This is ultimately the conclusion reached by a large part of public opinion in San Marino. A path that is only apparently easier to follow, but which in the long run will prove to be fraught with obstacles and consequences that are anything but easy to accept, if one has as a horizon that of social burden, solidarity and taking charge of fragility.
The legalization of abortion reaffirmed, and in a broadened sense, with the Referendum of San Marino contributes to putting in pole position the difficulty of being a mother and having an independent life. Motherhood imposes itself on everyone as a bond that in moments it is right to sever by right the freedom to female attention and hers to self-determination. The same desire for motherhood is allowed to move further and further back on the scale of female desires and aspirations. And the demographic collapse that has besieged our country for years is a confirmation of this. There is a fact that stands out above all: those born in Italy in 2021 for the first time will fall below the threshold of 400 thousand. A further step in the demographic decline trend of our country, a well known phenomenon but no less serious and urgent.
If faced with the principle of self-determination, in this case applied to abortion, we can do nothing, we can however intervene on the political and economic system, to avoid in Italy not only the general aging of the population, which is talked about a lot, but also a serious risk to our economy. This was repeatedly reiterated by Blangiardo, who has led the National Institute of Statistics since 2019. He knows well that the demographic crisis certainly cannot be resolved with a decree-law, serious investments are needed in favor of motherhood; it is necessary to recreate a positive climate of welcoming motherhood: a real social protection of motherhood.
I do not know which law on abortion in the coming months the Parliament of San Marino will formulate; I know however that our response to abortion must be given by intervening on all the social and economic measures that can be put at the service of motherhood, considering an extraordinary good for the whole of society. The answer to abortion must also be given by rediscovering motherhood as a value, returning to desire it, without placing it in antithesis with freedom.
