The company JCDecaux and the former deputy mayor of Prague 1 manipulated advertising contracts, the court ruled iROZHLAS
The District Court for Prague 1 on Wednesday recognized JCDecaux, its technical director Tomáš Tenzer and former Deputy Mayor of Prague 1 Michal Valent (ODS) in the case of renting advertising space in the metro. According to the verdict, the two defendants agreed on a lease, thereby committing the offense of obtaining an advantage in awarding the public contract. The court fined them for this. The verdict is invalid, all defendants appealed on the spot.

The case concerns the lease of the so-called citylights of the Staroměstská metro vestibule, which JCDecaux received from the City Hall of Prague 1 in 2016. According to the chairman of the judicial panel, Lukáš Svrček, Valenta, who was then sitting on the town hall’s property commission, favored the company by providing Tenzer with information about the intention to lease a competing company, EuroAWK, in the form of an MMS message. According to the judge, this led to the cancellation of the plan and the listing of a new one, in which the JCDecaux succeeded.

Unlike the previous hearing, when the Senate was chaired by another judge, the court agreed with the Public Prosecutor’s Office’s argument that it is also intended to lease public tenders. Defendants of the defendants claimed that it was not because it did not set criteria for the evaluation of bids.
They also referred to the methodology of the Ministry of the Interior, according to which similar plans should not be considered public tenders. According to Svrček, however, this is more than just information. “It’s a less formal manifestation of a certain competition,” he said.
In this context, according to him, it is not possible to freely dispose of non-public information about such a competition and communicate it to third parties, ie those who participate in the competition.
“Every professional, maybe even a beginner, must know that he cannot share such non-public information with anyone else,” the judge said. According to him, Tenzer then had to at least understand why Valenta was sending him the council’s planned resolution two days before it was discussed.
Punishment only monetary
The public prosecutor originally demanded conditional sentences for the accused, who are, in addition to the two men mentioned, JCDecaux itself. According to Svrček, however, I consider the offense to be commensurate with fines better. According to Wednesday’s verdict, Tenzer is to pay 100,000 crowns, Valenta and the JCDecaux company to pay 300,000 crowns.

Soud ani nepřijal tvrzení zastupitelství, že Valenta za svou pomoc získal od JCDecaux 240 000 korun vykázaných jako odměnu za konzultační činnosti. Valenta podle registru smluv ve stejné době dostával peníze za konzultace i od městské části Praha 1.
Firma JCDecaux předloni nepravomocně prohrála i soud s pražským dopravním podnikem ohledně provozu reklamy v MHD. Soud dal za pravdu podniku v tom, že je smlouva neplatná. Odvolací soud věc loni vrátil k novému projednání kvůli technickému pochybení v části původního rozsudku.
DPP trvá na neplatnosti kontraktu a firma JCDecaux kvůli tomu zahájila s Českou republikou mezinárodní arbitráž. Firmě také v polovině roku skončí velká smlouva s pražským magistrátem na provoz přístřešků pro MHD a dalšího mobiliáře, na kterém JCDecaux výměnou za údržbu a hrazení nájmu městu může provozovat reklamu. Město ji neplánuje prodloužit a přístřešky vlastněné firmou postupně nahradí vlastními.
